There is a question that comes up in almost every meeting where Chinese AI regulation is discussed, and it is not the one people expect. It is not which law applies to us. It is whether we are allowed to launch at all.
In China the practical gate is not a penalty after the fact. It is a filing before the fact, and a service that has not completed it does not go live. That single difference reorganises everything, because it moves compliance out of the legal review at the end and into the product decision at the start.
The second surprise is that China has no comprehensive AI law either. What it has instead is a stack of instruments issued one at a time, each aimed at a specific application as that application became commercially significant. Recommendation algorithms in 2022. Deep synthesis in 2023. Generative AI services a few months later. Content labelling in 2025. Emotional companion services and autonomous agents in 2026. Underneath sit three foundational laws (the Cybersecurity Law, the Data Security Law and PIPL), a layer of national technical standards doing much of the operational work, and a set of CAC registries that function as market access.
